Stell: Listen Up! My Favorite Podcasts

I enjoy talking about my favorite podcasts. These podcasts represent my favorite legal podcasts, as well as new podcasts I discovered in 2017. I hope you will add some of my picks to your playlist and share your own favorites with me.

S-Town. S-Town is an investigative journalism show created by the producers of the award-winning podcast, Serial. The host, Brian Reed, created S-Town in seven chapters and unlike the common form of releasing a chapter a week, released all seven chapters at once allowing followers to binge listen. The podcast was downloaded a record-breaking 10 million times in four days.

Reed lets us in on a secret; S-Town is actually a euphemism for “Shit Town”, the colorful name bestowed on the town of Woodstock, Alabama by the show’s even more colorful protagonist, John B. McLemore.

McLemore sends an email to Reed, a staff member of This American Life, asking him to investigate a murder in Woodstock. The journey Reed and McLemore takes is breathtaking with shocking turns of events. If you have ever lived in the rural south, you will recognize the characters and their stories, and your heart will rise and break along with theirs.

Stay Tuned With Preet with Preet Bharara. Preet Bharara is the former U.S. Attorney for the Southern District of New York. Bharara fought corruption, financial fraud and violent crime. His most recent claim to fame? He was fired by President Trump. His podcast launched in 2017 and opens with the story of President-Elect Trump asking him to stay in office, followed by his firing a few months later. Bharara’s guests have included Senator Jeff Flake, Leon Panetta, and Catherine Hoke discussing her work in moving inmates to entrepreneurs. Bharara’s show chronicles the Mueller investigation and breaking news stories as well. It’s no surprise that a trial attorney such as Bharara is a captivating podcast storyteller.

Sex at Work with Leto Copely and Valerie Johnson, The Law Sisters. While Leto and Valerie are not actual sisters, they have practiced law together in Durham, North Carolina for 20 years. Their comfortable banter and easy repartee make learning about the law a lot easier.  Sex at Work is an entertaining and informative look at the world of employment law played out each week in discussions of recent scandals, cases in the news (Uber we are looking at you) and segments such as “Bad Boss of the Week”. This is the Law Sisters first go at a podcast, but it certainly does not feel that way.

Ear Hustle. An intriguing name, to ear hustle is to eavesdrop. Or, as the Urban Dictionary says, “all up in somebody else’s business without knowing the details”. When you finish Ear Hustle, you will know the details. Co-produced by San Quentin inmates Earlonne Woods and Antwan Williams, along with Bay Area artist Nigel Poor, the series explores life as a prisoner inside San Quentin.

The podcast does not preach against the ills of mass incarceration or of a justice system that has glaring faults, instead, the show humanizes men who are spending decades in prison. They talk about everything from family and heartbreak to the difficulties of finding a compatible roommate.

With no training in the medium, rudimentary equipment, and boatloads of bureaucracy and red tape, Woods, Williams and Poor are becoming master storytellers. I am hooked. As I listen, I am reminded of Bryan Stevenson’s quote in his excellent book on social justice, Just Mercy, “Each of us is more than the worst thing we’ve ever done.”

Legal Talk Network. Legal Talk Network is a curated collection of podcasts featuring some of the best known names in practice management, marketing and legal news reporting. There are podcasts for law students, new lawyers, senior lawyers, in-house counsel and paralegals. This is a “must add” to your podcast feed as new content is created daily.

Bulldog Bites with Mark Enriques. Mark is a business litigator in the Charlotte office of Womble Bond Dickinson (formerly Womble Carlyle). Bulldog Bites, featuring a handsome Winston the famous WCSR bulldog mascot, provides corporate attorneys with tips and insights from general counsel, politicians, analysts and leading business professionals. Mark’s show about Womble’s combination with the UK firm Bond Dickinson is an interesting inside look at how two firms across the pond met and fell in love.

Revisionist History. One of my favorite social scientists and authors, Malcolm Gladwell, examines the way the passage of time “changes and enlightens our understanding of the world around us.” Or as Malcolm says of the show, “my podcast about things overlooked and misunderstood.”

One of my favorite episodes from last season was “My Little Hundred Million”. This episode looks at the ideologies behind charitable giving and educational philanthropy. This season features a fascinating look at some of the biggest names in the civil rights movement, along with names we may not know, but stories we will not forget.

The Gen Why Lawyer with Nicole Abboud. Nicole practiced law for 5 years before acknowledging a shocking revelation; she hated practicing law. She launched a podcast and a business, Abboud Media, where she works with lawyers to build their brands and grow their businesses. Each week, Nicole talks with lawyers who are sharing courageous stories and offering tactical advice about practicing law in unconventional ways.

The West Wing Weekly with Joshua Malina (actor from The West Wing and Scandal, along with Hrishikesh Hirway of Song Exploder podcast). The WWW is an episode-by-episode discussion of my favorite TV show of all time, The West Wing. If you loved the show, you will love the podcast. If you are new to the show, watch it on Netflix and follow along with the podcast. Josh and Hrishi are entertaining, have good banter and the show has high production value. The guest stars include actors from the show, politicians, staffers from former White House administrations and the fabulous creator of the West Wing, Aaron Sorkin.

Masters of Scale with Reid Hoffman. Internet entrepreneur, venture capitalist and LinkedIn co-founder Reid Hoffman interviews famous founders such as Mark Zuckerberg of Facebook, Sheryl Sandberg of Facebook and Lean In, Eric Schmidt of Google and Sara Blakely of Spanx.

Hoffman explores ideas such as leadership, building company culture, critical problem solving and gender equality in the workplace. I’m currently reading Hoffman’s book, The Start-up of You.

The Secret to Victory. This podcast is about how the most competitive athletes in the world use defeat to fuel their next win. Host Domonique Foxworth, ESPN writer and former NFL player, interviews sports royalty such as Serena Williams, and Peyton and Eli Manning.

WDW Prep to Go. Walt Disney World. Enough said. Well, perhaps a little more. Shannon Albert, the host of this delightful podcast offers tips to planning the most magical Disney vacation. Her website, WDW Prep School, is a “must visit” if you are planning a trip and her six step planning process is a great model.

GBA Members Deliver Books to Jones Elementary

This is so special, I think I’m going to cry.

On December 19, 2017, eleven volunteers from the GBA delivered holiday cheer and more than 200 well-wrapped books to the K-5 students in the Neighborhood Leadership Program (NLP) at David D. Jones Elementary School. As always, the children were happy and excited to receive their gifts. One student remarked, “This is so special, I think I’m going to cry.” This year’s GBA Elementary School Project was one of our most successful, thanks to generous member donations of over $3,000 and a $500 matching grant from the GBA Foundation, and the time and care members showed wrapping the books at the GBA Holiday Party on December 13.  As has been done in years past, the books were purchased through Jones Elementary’s Scholastic Book Fair, which provides the school with funds that can be used to purchase new books for the school library and classrooms. Sufficient funds were raised to purchase additional books as gifts for all fifth graders graduating from Jones Elementary this year in both the NLP and Spanish Immersion programs.

Part-Time Staff Attorney Position Announcement

The Children’s Law Center of Central North Carolina (CLC) is a nonprofit organization based in Winston-Salem providing children with quality legal advocacy focusing on domestic violence issues, high-conflict custody cases, and the rights of children in public education.  CLC is searching for a Staff Attorney to work in the Greensboro office who will successfully advocate for the otherwise voiceless children in our community. 

The Staff Attorney serves as Guardian ad Litem to children involved in Guilford County Chapter 50B civil domestic violence cases.  Responsibilities include:  interviewing the parties, children and collateral witnesses; reviewing civil and criminal court records; preparing written reports for the court; and assisting in the supervision of volunteers and law students. Requirements are a NC licensed attorney with 3-5 years of experience preferably in child advocacy or family law with strong written and communication skills.  Must be willing to manage caseload in Guilford County. Message from the President, January 2018

It’s hard to believe we have already arrived at the half-way point of my term as President and at the threshold of a brand new year.   Such a point in time provides a great opportunity to reflect on the accomplishments of the past year, and to envision the shape and scope of the year to come.

I offer gratitude and appreciation to Diane Lowe for her energy, insights, enthusiasm, and commitment to our mission.  I extend my thanks and congratulations to our membership for making the past few months truly memorable.  For every person who served on our Board or a committee, helped financially or in-person at the Habitat House; donated money or delivered wrapped books to Jones Elementary School,  stuffed a backpack for BackPack Beginnings, served the less fortunate at the Potter’s House, sponsored a new attorney at the swearing-in ceremony, encouraged an attorney to join us at the Mix-n-Mingle,  presented a moving memorial for one of our former colleagues, applied their talents and time to ensure a professional and informative newsletter each month, volunteered for the Second Chance Project,  nominated deserving members for recognition for pro bono and community service, read books to the children at Hampton Elementary School, or helped us celebrate the season by planning our holiday party – Thank You!   Take a moment and think of the ripple effect of all the amazing accomplishments of our Bar since August.

As much as we achieved in the last year, there is much in store for our membership in the new year.  At the beginning of my term, I formed a committee dedicated to creating more opportunities to interact and network with our colleagues in the High Point Bar Association.  I am happy to say that, with the help of committee members Allie Petrova, Nicole Patino, Fred Hamlet, and Justice Edmonds, the GBA and HPBA will have two wonderful opportunities for fellowship!  Our first joint event is the “Battle of the Bars” trivia night on Thursday, January 25, 2018 at World of Beer.  The event will feature drinks and hors d’oeuvres starting at 6:00 p.m., and a dedicated trivia host starting at 7:00 p.m.  The GBA members in attendance will take on the HPBA members, and the winning bar will take home a trophy, to be kept until the next showdown.  Calling all GBA trivia buffs – we need you!  The second event will be a joint picnic with the HPBA at the Grasshoppers’ stadium on Sunday, May 20, 2018,
at 2:00 p.m.!

Also on the horizon is our annual Legal Aid Fundraiser at the Greensboro Science Center’s Aquarium on Saturday, February 17, 2018, from 6:30 p.m. to 9:30 p.m.

The event features beer and wine tasting, raffle prizes, and an incredible buffet of dinner and dessert.  Mark your calendars and please consider becoming a sponsor of this event or making a donation to this worthy cause.  Information to enable you to become a sponsor is included in this newsletter.

MEMORIAL RESOLUTION

FOR

J. REED JOHNSTON, JR.

BE IT HEREBY RESOLVED, by the Greensboro Bar Association at its regularly scheduled meeting on November 16, 2017, that:

WHEREAS, J. Reed Johnston, Jr. died on May 20, 2017, in Greensboro, North Carolina after a long period of declining health; and

WHEREAS, this Association desires to reflect upon his exemplary career and service to the Bar and his fellow citizens, and the minutes should therefore reflect that:

Reed was born in Pittsburgh, PA on April 22, 1944 to John Reed Johnston and Pauline Barton Johnston. His family moved to Winston-Salem in 1946, where he grew up and went to school at R.J. Reynolds High School. After completing his junior year of high school, he was accepted as a freshman at the University of North Carolina, Chapel Hill. He received his high school diploma after he completed his first year at the university.

Following graduation from UNC-CH in 1965, Reed entered the School of Law at UNC-CH and began his life-long commitment to the practice of the law. When asked when he decided to become an attorney, Reed always answered he never wanted to do anything else. In 1968, he received his Juris Doctor degree from the University of North Carolina, Chapel Hill, North Carolina where he served as articles editor of the Law Review, was a member of the Order of the Coif and graduated with high honors.  He was admitted to the practice of law in North Carolina in 1968.

Following graduation from law school, Reed moved to Washington, D.C. and worked as an appellate attorney in the Civil Division of the U.S. Department of Justice. In 1971, Reed joined the faculty of Washington University School of Law in St. Louis, Missouri.  He was admitted to the Missouri Bar and later practiced law in St. Louis for several years.

Reed moved back to North Carolina in 1983, and joined the law firm of Tuggle Duggins in Greensboro as a member of its litigation practice. Reed was a director of the firm and practiced with the firm of Tuggle Duggins for over 30 years. During his time at the firm, he served as a president of Tuggle Duggins and oversaw the firm’s transition from its original offices at 228 W. Market Street to the current location in the Lincoln Financial building.  He continued to assist the Firm even as his health declined and as he transitioned to senior counsel.  He was a member of the Greensboro, the North Carolina and the American Bar Associations.  His practice focused on business, insurance, ERISA, intellectual property and appellate litigation. Reed was admitted to the bar of the United States Supreme Court, the U.S. Tax Court and the U.S. Courts of Appeal for the District of Columbia, Second, Fourth, Fifth, Sixth, Eighth, Ninth, and Eleventh Circuits.  Reed handled appeals in these courts and the appellate courts of various states including North Carolina, Missouri, Illinois and New York. He was AV designated by Martindale Hubbell.

Reed met his wife Sharon “Sherry” O’Donnell while they were both students at UNC-CH School of Law.  They have two sons, Sean and Michael.  In addition to being an avid supporter of Tar Heel sports, Reed enjoyed spending free time in his woodwork shop. He loved nothing better than spending his weekends with his sons working on projects for the house or a gift for the family. Always interested in photography, his time was spent not only capturing family memories but searching for interesting examples of old tobacco barns and the Carolina countryside. During the last three years, Reed received the gift of a beautiful granddaughter, Maddie, who brought a special joy and light to his life.     

Reed is survived by Sherry, his wife of 47 years, sons John Reed Johnston, IV “Sean,” wife Cyndi and granddaughter Madison Harper of Durham and Michael O’Donnell Johnston of Oakton, VA; sisters Carolyn Carroll (Ed) of Danville, VA; Pauline Johnston of Winston-Salem; Rebecca Johnston of Fayetteville; sister-in-law Patricia O’Donnell of Annandale, VA; brother-in-law H. Scott Sigler of Atlanta, GA; nephews Edward Carroll (Barbara); Gregory Carroll; Jeremy Carroll ( Elizabeth); Jeffery Sigler (Sage), Kevin Sigler (Heather), Tyler Sigler (Sasha), as well as eight great-nieces and nephews.

NOW,  THEREFORE, BE IT RESOLVED that the Greensboro Bar Association, in this duly assembled meeting of its members, does hereby adopt this Resolution to honor and memorialize the life and works of our colleague J. Reed Johnston, Jr., and directs that this Resolution be made part of the official records of the Association and that a true copy hereof shall be delivered to Reed’s family in token of the esteem, high regard, and enduring affection in which he was held by his friends and colleagues of the Bar.

The ACPL recognizes attorneys who have distinguished themselves in the practice of parliamentary law, including lawyers who advise conventions, condominium and homeowner associations, governmental bodies, and nonprofits. Taliercio is a Professional Registered Parliamentarian and a Fellow in the ACPL.

The holiday season is upon us, also known as “the season of giving.”  The Online Giving Study conducted by the Network for Good found that a third of all charitable donations in the U.S. happens in December, and a whopping 22 percent occurs on the final two days of the year.  As we enter this wonderful (and sometimes overwhelming) season, I wanted to highlight some opportunities for our members to give to others less fortunate.

Based on the responses to the survey the Community Involvement Committee sent to our membership a few months ago, the Committee has partnered with the Volunteer Center of Greensboro to provide us with two fantastic ways to help others:

Tiny Houses Greensboro has broken ground on North Carolina’s first tiny house community for the homeless!  Tiny Houses convenes a 15-member work crew every Saturday from 9:00 a.m. to 2:00 p.m. at 4120 Causey Street in Greensboro.  Much like Habitat for Humanity, prior construction experience is welcomed but not required.  Please visit www.volunteergso.org and sign up for a work day.

The GBA has a long history of partnering with Jones Elementary School to provide books for the students at the holidays and for the graduating fifth graders. Now we have an additional way to assist at Jones. BackPack Beginnings donates food to Jones to distribute to students’ families who are in need. Volunteers are needed the 2nd and 4th weeks of each month from 2:30 to 4:00 p.m. to distribute donated food to the classrooms. Please visit www.volunteergso.org and sign up for a shift. Additionally, volunteers may stuff bags and work in the food pantry at their convenience. Please contact Kimberly Simmons, Jones Elementary Social Worker, at 336.370.8230 if you would like to help.

Speaking of Jones Elementary, if you have not yet had a chance to make your donation for the annual book project, please consider mailing a check made payable to “GBA Foundation” (include “Jones Elementary” on the memo line) to Post Office Box 1825, Greensboro, NC 27402, or donating online via PayPal.  We hope you will also join the GBA’s “elves” and wrap some of the Jones books at our annual holiday party at Elon Law School on Wednesday, December 13th from 5:30 p.m. to 7:30 p.m., and volunteer to distribute the wrapped books to the children on Tuesday, December 19th at 8:30 a.m.

Our Community Involvement Committee has also continued its relationship with Urban Ministries and continues to seek volunteers to serve food to the less fortunate at the Potter’s House.  The next opportunity is on Sunday, December 17th from 9:00 a.m. to 12:30 p.m.  Please volunteer by Melissa Duncan at mduncan6@elon.edu. A few years ago, I asked NC Bar Association staffer Joyce Brafford, “If I can attend only one conference this year, what should it be?” Joyce did not hesitate, the Clio Cloud Conference. I am so glad I took her advice.

Clio is a cloud based legal technology company and Clio hosted their first conference in 2013 with 200 attendees. I attended my first Clio Conference in Chicago in 2015, then again in 2016. This year the conference moved to New Orleans in September and I attended for the third year in a row along with 1,200 others. What keeps me going back?

There are several standout features of the conference. The conference is highly produced and includes excellent facilities and great networking. The conference extras include hangover tables and massage chairs, plenty of food and beverage, and fun add-ons such as “Clio After Dark” after-conference socials.

As everyone attending the conference is a forward thinking legal professional , many conversations start at a different level – “what can we do better, more effectively and more efficiently?”, along with, “what does the future hold and what is my role in that future?”. These are individuals who have embraced technology and are using it in every part of their practice.

One of my favorite aspects of the conference is getting to know the Clio staff. CEO Jack Newton and Lawyer in Residence, Joshua Lennon are wandering the halls and looking to join in conversations or share a table at the social events. The staff is warm and welcoming and they embrace the mission of the company.

The speakers are forward thinking. There are multiple tracks offered: Clio University (Clio users), business of law and legal technology.

Keynote Speakers

The keynote speakers are always fantastic and this year was no exception. Canadian astronaut, Commander Chris Hadfield, was perfectly on theme with Clio’s yearlong update to their software, which they christened Apollo. Commander Hadfield had a beautiful slide show of photos from his time on the International Space Station. He shared his experience of astronaut training including preparing for emergencies so that when something goes wrong, they are ready to troubleshoot and repair.

Haben Girma, the first deaf-blind Harvard Law graduate, and also on the cover of the ABA Journal in September, spoke about challenges she faced in life that prepared her for her work as a disability rights advocate who works to promote accessibility and inclusion.

Preet Bharara is a former U.S. Attorney for the Southern District of New York. His inspirational remarks encouraged lawyers to strive to be their best. Bharara is now the host of the “Stay Tuned with Preet” podcast that tops my “must listen to” list.

Conference Themes

Over 30 speakers addressed topics such as client experience, artificial intelligence, disruption, collaboration, generational communication, social engagement, and how these topics are influencing the future of law.

21st Century Skills

Many of the speakers spoke about the skills needed to be a 21st century legal professional including: cultural competency, leadership, project management, business acumen, high risk tolerance, technology, social networking, collaboration, communication and presentation, forming teams and problem solving that includes innovation.

Conference Highlights

The show opened with a New Orleans Jazz Band and dancing Clio employees in their signature Clio Conference t-shirts and jeans, an early nod that this is not your standard legal conference. Jack Newton opened the conference reporting on changes in the Clio product, continued innovations the company is making, and finally rolling out the 2017 Legal Trends Report.

If you are looking at a report that analyzes what is happening in the world of solo and small firms, this report is a must-read. Clio introduced the report in 2016 and it was a highly anticipated feature of this conference.

The report is based on anonymously aggregated data from 60,000 Clio users. The most shocking news in the report is that in an 8-hour day, lawyers spend 2.3 hours of the day working for clients, they bill their clients for 1.9 hours of their day and they collect from clients for 1.6 hours of their day.

Many bloggers, lawyers, legal consultants and marketing professionals are talking about the 2.3-hour billable day and the missing 6 hours. There may be a variety of reasons for the low numbers including the number of younger lawyers who may be Clio users but do not have a solid book of business, as well as less overall work for lawyers regardless of age and stage.

Clio users acknowledged that in the remaining 6 hours they spend time marketing and developing new business, administrative work, licensing / CLE, office administration, generating / sending bills, configuring technology, and collections.

George Psiharis, Clio’s Vice President of Business Operations, presented a session where he drilled deeper into the report. The report also provides an index of billable hour rates across the country, includes responses from 2,000 consumers of legal services about what clients are looking for in a lawyer, and offers tips on how to set targets for success in your firm that allow you to measure your practice. At a conference where there is plenty of conversation around artificial intelligence, Psiharis offers hope for lawyers, “Data driven lawyers eat robots for breakfast.”

Moving Forward

Who should attend the Clio Conference? I am not a Clio user and I still consider it the best conference I attend. If you are a solo or small firm lawyer, paralegal or other legal professional there will be conference sessions you will find of interest. If you are interested in building a 21st century law firm, this conference is for you.

Finally, if you want to participate in conversations that center around the changing and challenging legal marketplace, make plans to attend. The conference is scheduled for October 4-5, 2018 in New Orleans at the Hyatt Regency Hotel. Early Bird Registration is now open. I’ll see you in New Orleans.

Attorney Jeremy Foltz Receives Pro Bono Award

The Greensboro Bar Association’s 2017 Pro Bono Award was presented to Jeremy B. Foltz at the November 16 member meeting.  Jeremy first practiced law in Texas. As soon as he became licensed in North Carolina, he joined the Greensboro Bar Association and contacted the Greensboro Legal Aid Office and asked if he could volunteer. Initially, he helped out with some routine housing cases. As time passed, he undertook some more complex housing matters, where his litigation and insurance law experience proved to be a major benefit for his clients. Since 2015, our award recipient has handled a total of ten (10) Legal Aid referrals with outstanding results. The Greensboro Bar Association is pleased to recognize Jeremy for his service.

Brooks Pierce Receives Top Ranking in 2018 Edition of Benchmark Litigation
